Refund Policy

1. Our Commitment to You At Himdev, we are dedicated to your satisfaction with our herbal Ayurvedic dietary supplements. We strive to provide high-quality products and a transparent purchasing experience. This Refund Policy outlines the terms and conditions for returns and refunds for products purchased through our website by customers in Canada, the United States, and India. We aim to comply with all applicable consumer protection laws in these jurisdictions.

 

2. Return Eligibility

  • 2.1. Timeframe for Returns: You may initiate a return request within 30 days from the date of delivery for most eligible reasons. Specific conditions and timeframes may apply based on the reason for return and your country of residence, as detailed below.  

  • 2.2. Reasons for Eligible Returns: We accept returns for products under the following conditions :  

    • The product arrived damaged (e.g., during shipping) or is defective (e.g., manufacturing fault, contamination).

    • You received an incorrect item (i.e., not what you ordered).

    • The product significantly differs from its description on our website or its labelling (misrepresentation).

  • 2.3. "Change of Mind" Returns (Unopened Products Only):

    • For Customers in India: In accordance with the Consumer Protection (E-Commerce) Rules, 2020, you may return unopened and unused products in their original, resalable condition within 14 days of delivery if you change your mind.  

    • For Customers in Canada and the USA: Currently, there is no universal statutory "cooling-off" period for online purchases that mandates "change of mind" returns. However, Himdev may, at its discretion, accept "change of mind" returns for unopened and unused products in their original, resalable condition if initiated within 10 days of delivery. Please contact our Customer Service to inquire about eligibility.

3. Condition of Returned Products

  • 3.1. Unopened Products: To be eligible for a "change of mind" return (where applicable) or returns due to an incorrect item shipped by Himdev (where the product itself is undamaged), the product must be in its original, sealed packaging, unused, and in a resalable condition. All seals must be intact.  

  • 3.2. Opened Products: Due to the consumable nature of Ayurvedic dietary supplements, and for hygiene, safety, and regulatory reasons (including U.S. FDA CGMP regulations for handling returned dietary supplements ), opened products are generally non-returnable and non-refundable. Exceptions for opened products will ONLY be considered under the following specific circumstances:  

    • Manufacturing Defect Discovered Upon Opening: If a defect (e.g., evidence of contamination, incorrect quantity not apparent from external packaging, damaged internal seals that were intact externally) is found immediately upon opening the product. This must be reported to Himdev Customer Service within 48 hours of opening.

    • Verified Adverse Reaction: If a customer reports an adverse reaction that, after investigation by Himdev, is reasonably considered to be potentially linked to the product. Please refer to Section 8: Addressing Adverse Reactions.

4. Non-Returnable Items The following items or conditions are generally not eligible for return or refund:

  • Products explicitly marked as "Final Sale" or "Non-Returnable" (e.g., clearance items), provided this is clearly communicated prior to purchase and legally permissible.

  • Products damaged due to customer mishandling, improper storage, or misuse.

  • Opened products where the reason for return is subjective preference (e.g., dislike of taste or smell) or perceived lack of efficacy, unless Himdev offers a specific "satisfaction guarantee" and the return meets the explicit terms of that separate guarantee.  

  • Products returned without prior authorization from Himdev Customer Service or returned outside the specified return timeframe.

5. How to Initiate a Return To initiate a return, please follow these steps :  

  • Contact Customer Service: Email us at info@himdev.com or call us at +1-xxx-xxx-xxxx to request a return.

  • Provide Information: Please provide your order number, the name of the product(s) being returned, the reason for the return, and the date of purchase/delivery.

  • Evidence for Claims: For returns due to damage, defect, or incorrect item, you will be required to provide clear photographic or video evidence of the issue. This helps us verify your claim and improve our services.  

  • Return Authorization: Do not ship any products back to us without first receiving a Return Merchandise Authorization (RMA) number and return instructions from our Customer Service team.

6. Shipping Your Return

  • 6.1. Return Shipping Costs:

    • Customer Covers Costs: Himdev will not cover or reimburse reasonable return shipping costs if the return is due to a product being defective, damaged upon receipt, an incorrect item shipped by Himdev, or if the product was significantly misrepresented.  

    • Customer Covers Costs: For "change of mind" returns (where accepted) or any other return reason not due to Himdev's error or a product defect, the customer is responsible for all return shipping costs. 

  • 6.2. Packaging Instructions: Please package returned items securely, preferably in the original shipping packaging if available, to prevent damage during transit. Include the RMA number clearly on the outside of the package.  

  • 6.3. Return Address: The correct return mailing address will be provided by our Customer Service team along with your RMA number. Do not send returns to our corporate address unless specifically instructed.

  • 6.4. International Return Shipping (Specifics for Customs, Duties, Refused Packages):

    • Customs, Duties, and Taxes: For orders shipped internationally (outside of Himdev's primary shipping country or between Canada, USA, and India), the customer is solely responsible for any import duties, taxes, customs clearance fees, or other charges levied by the destination country upon original receipt and on any returned items, unless the return is due to Himdev's error.  

    • Refused Packages: If an international order is refused by the customer or by the destination country's customs authorities due to non-payment of duties, taxes, or other import charges, and the package is returned to Himdev, the original shipping charges paid by the customer will not be refunded. Any return shipping costs, duties, or taxes incurred by Himdev to retrieve the refused package will also be deducted from any eligible refund amount.

 

7. Refund Process

  • 7.1. Method of Refund: Approved refunds will generally be processed to the original method of payment (e.g., credit card, debit card, PayPal). For customers in India, refunds will be processed to the original payment method as per the E-Commerce Rules. In specific circumstances, and with your explicit consent where required by law, a store credit may be offered.  

  • 7.2. Refund Timeline: Once your returned item is received and inspected by Himdev, we will notify you of the approval or rejection of your refund. If approved, refunds will typically be processed within 7-10 business days. Please note that it may take additional time for the refund to appear on your bank or credit card statement, depending on your financial institution.

    • For Customers in India: We will strive to process refunds within the timelines stipulated by the Consumer Protection (E-Commerce) Rules, 2020 (often cited as within 15 days of return acceptance).  

  • 7.3. Potential Deductions from Refund:

    • Original shipping charges are generally non-refundable, especially for "change of mind" returns, unless the return is due to Himdev's error or a defective product.  

    • Return shipping costs, if they are the customer's responsibility (see Section 6.1).

    • Restocking fees are generally not charged by Himdev. If a restocking fee were to apply in a unique circumstance, it would be clearly communicated to you before you complete your purchase and would comply with all applicable laws.  

  • 7.4. Currency for International Refunds: All refunds for international orders will be processed in the currency of the original transaction. Himdev is not responsible for any discrepancies in the refunded amount due to currency exchange rate fluctuations applied by your bank or payment processor between the time of purchase and the time of refund.  

8. Addressing Adverse Reactions Your health and safety are important to us. If you believe you have experienced an adverse reaction to a Himdev Ayurvedic supplement, please follow these steps:

  • 8.1. Immediate Actions:

    • Discontinue use of the product immediately.  

    • Consult with your healthcare professional to discuss your symptoms and seek appropriate medical advice.  

  • 8.2. Report to Himdev: Please report the suspected adverse reaction to Himdev Customer Service as soon as possible by contacting us at [support@himdev.com] or [Your Phone Number]. Be prepared to provide the following information:

    • Your name and contact details.

    • Order number.

    • Name of the Himdev product.

    • Product batch number and expiry date (found on the packaging).

    • A detailed description of the reaction experienced (symptoms, onset, duration).

    • Information on any medical attention sought or advice received.

    • Details of any other medications, supplements, or substances you were taking concurrently.

  • 8.3. Himdev's Review Process: Upon receiving your report, Himdev will acknowledge it promptly. Our team will carefully review the information provided. A decision regarding a refund or replacement for the product in question will be made on a case-by-case basis following our internal review. This does not constitute an admission of causality but is part of our commitment to customer care and product vigilance.

  • 8.4. Regulatory Reporting & Disclaimer: Himdev is committed to product safety and compliance with all applicable regulatory reporting requirements in Canada, the USA, and India.  

    • For U.S. Customers: We comply with U.S. Food and Drug Administration (FDA) regulations regarding the reporting of serious adverse events associated with dietary supplements.  

    • For Canadian Customers: We adhere to Health Canada's requirements for monitoring and reporting adverse reactions related to Natural Health Products (NHPs).

    • For Indian Customers: We comply with the guidelines of the Food Safety and Standards Authority of India (FSSAI) and/or the Ministry of AYUSH concerning product safety and consumer grievance redressal. Reporting a suspected adverse reaction to Himdev is for our internal review and potential refund/replacement. It does not replace the need for you to seek medical advice from a qualified healthcare professional. You also have the right to report adverse reactions directly to the relevant national health authorities (e.g., FDA MedWatch in the USA , Health Canada, or appropriate consumer forums/health authorities in India).  

9. Important Legal Disclaimers Please review the following important disclaimers, which are also available on our website:

  • For Products Sold in/to the USA: "These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease."  

  • For Products Sold in/to Canada: (Wording to align with specific NHP licenses) "This product is a Natural Health Product. Claims regarding its efficacy may be based on traditional Ayurvedic use or scientific evidence as reviewed by Health Canada. This product may not be intended to diagnose, treat, cure, or prevent any disease, unless such a claim is specifically licensed by Health Canada for this product. Always read and follow the label."  

  • For Products Sold in/to India:

    • If classified as an FSSAI product (Health Supplement/Nutraceutical): "This product is a health supplement. Not for medicinal use. This product is not intended to diagnose, treat, cure, or prevent any disease. Please consult your healthcare professional before use."  

    • If licensed as an Ayurvedic Medicine under AYUSH: Disclaimers will align with AYUSH regulations.

  • General Disclaimer (All Jurisdictions):

    • "Consult Your Healthcare Professional: The information provided on this website and on our product labels is for general informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or before starting any new supplement regimen."

10. Policy Modifications Himdev reserves the right to modify this Refund Policy at any time. Any changes will be effective immediately upon posting the revised policy on our website. Your continued use of our website and purchase of our products after any such changes constitutes your acceptance of the new Refund Policy.
